Unsure About Your Debt? Call the Saffa Law Firm Today.

Debt is always a stressful issue that almost every person in the world deals with. We all fall behind, but that does not mean that your life is over. Debt can be overcome through multiple legal avenues, but always remember that you have rights when it comes to debt. Typically any form of overly harassing debt collection practice is deemed illegal and covered under the Fair Debt Collection Practices Act (FDCPA).

Generally debt collectors are not allowed to:

  • Threaten
  • Use Profanity
  • Arrest You
  • Impersonate a Government Official
  • Impersonate an Attorney
  • Disclose Your Debt Publicly
  • Contact Before 8am or after 9pm

Collections for Unsettled Debt

Regardless, in the end debt collectors will do everything that is legally possible to get what they are owed. Collectors are allowed to contact you through most major forms of communication and are legally allowed to contact you at work, home, and through other people you know. If debt collectors cannot reach you or if you refused to pay there are a few different avenues that they might take.

Ways that collectors may acquire what is owed includes:

  • Wage Garnishments The ability to retain portions of your income for the purpose of settling your debt. In North Carolina your wages cannot be legally garnished for the purposes of personal debt, such as car loans and credit cards. The only items that may be garnished are ambulance services, alimony, child support, student loans, and/or taxes.
  • Judgement – A Court ordered mandate to pay another party what is owed.
  • Lien – A Creditors claim to a portion of your assets if sold (Note: if selling your assets does not cover the full extent of the debt you may not be legally able to sell your assets).

These methods are used by most debt collectors seeking payment for any number of debts including medical and credit card. Furthermore, it is important to note that debt can be passed down from spouses and possibly other family members, it is because of these facts it is important that you stay on top of your debt. While there are statutes of limitations to your debt, it is extremely important that you review your legal options with a Charlotte debt relief attorney today.

Other Forms of Debt Colleciton

Though many times debt collectors will go through the courts to resolve your pending debt, there are also other options that they might explore that are less formal. The first of these would be a "demand letter" which is a more formal way of making contact with the debtor. Demand letters typically involve a full outline of the owed amount as well as forms of payment plans that the debtor can partake in to more effectively pay back what is owed.

Another popular form of debt collection is the use a collection agency to acquire the amount owed. A debt collection agency is typically used because a business cannot expend the necessary resources to acquire the owned amount. In return for acquiring the necessary funds, many agencies will receive a portion of the debt recovered from the debtor. A debt agency will use a variety of methods to acquire the debt as they are more capable of acquiring information about the debtor in question. Some tactics used by an agency include: numerous calls/notices, showing up at the debtor's residence, and contacting family, friends, and neighbors to confirm they are reaching the right debtor.

Essentially their most useful tactic is persistance, however, it is important to note when these collectors are interacting with anybody that is not the debtor they may never disclose the reason they are inquiring about the debtor. They may never disclose that a debt is owed and how much the debt is.

Lastly, if the debt owed it is not a substantial amount a creditor may go through a small claims court to acquire the amount owed. This is a legal form of acquiring debt, however, it is a quicker process where both sides may seek legal representation, but it is not necessary. The debt will then be settled quickly by the court and moved on. In different states the amount necessary to qualify as a small claim is different, so it is important to contact a qualified debt relief attorney if your creditor is proposing this option.
