Is Chapter 7 Bankruptcy Right for You?

Chapter 7 may be a good option if you:

  • have "unsecured debts" (i.e. credit cards, medical bills, personal loans, etc.) that you can no longer afford to pay
  • have "secured debts" (i.e. home loan, vehicle loan, furniture loan, etc.) that cannot afford to keep and wish to surrender
  • have had a lawsuit filed against you over a debt
  • are facing a vehicle repossession

When Filing for Chapter 7 bankruptcy, you can:

  • keep and repay any "secured" debts (i.e. home, vehicle or furniture loans) that you want to keep
  • surrender (i.e. give back) any secured debts you no longer wish to keep
  • discharge (i.e. wipe out) your "unsecured" debt (i.e. credit cards, medical bills, personal loans, etc. - except for things like student loans, alimony, child support)

If you were to lose a home in a foreclosure, or a vehicle in a repossession, the creditor could then sell the property they took back and sue you for any balance left over. This is called a "deficiency claim". However, when you file for Chapter 7 bankruptcy and surrender property back to the creditor, they get the property back. They cannot then later sue you for any deficiency. This is another big protection afforded through bankruptcy.
